Terms of Use (T&C) - Sitaara

Mareo Steps Pvt Limited ("Mareo," "Sitaara," "we," "us," or "our") operates the brand "Sitaara" (or "Sitaara Club" / "sitaara.club"). These Terms govern your use of the Sitaara platform, including our mobile applications (iOS and Android), websites, digital content services (Masterclasses, videos, AI assistant), and any current or future e-commerce activities (collectively, the "Platform").

1. Acceptance of Terms and Introduction

By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, and Sitaara's Privacy Policy, which form a legal agreement between you and Mareo Steps Private Limited.

2. Use of Services and User Obligations

2.1 Registration and Account

Users must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 E-commerce and Marketplace (Future Scope)

Sitaara currently offers digital services and content. We plan to expand our business to include a Direct-to-Consumer (D2C) e-commerce channel and a marketplace, selling our own products and those from other brands.

  • Applicability: Sections of these Terms relating to purchases, returns, and shipping will become fully applicable upon the launch of the Sitaara e-commerce or marketplace platforms.

  • External Sales: If our products are sold on third-party marketplaces or quick-commerce platforms, the specific purchase, payment, shipping, and return terms of that external platform will apply, in addition to our core terms.

  • Marketplace Liability: When purchasing products from third-party vendors on our future marketplace, Sitaara's liability will be limited to facilitating the transaction.

2.3 Prohibited Conduct

Unauthorized use of the Platform is strictly prohibited. Users must not engage in any activity that is harmful, abusive, defamatory, or violates any laws or the rights of others (including other users, experts, or employees) on any of our platforms, including public forums, comments, or WhatsApp groups.

3. Disclaimers and Limitation of Liability

3.1 Professional Advice Disclaimer (Crucial)

Sitaara offers parenting advice and content, including Masterclasses, videos, and infographics. All advice and content is curated by or from verified experts in fields such as child psychology, pediatrics, and early years education.

  • Not Medical or Professional Counsel: The platform offers parenting advice and product enablers; it is not a substitute for professional medical advice. All advice is intended as personalized, informational guidance only and is not a substitute for professional medical, pediatric, psychological, or clinical diagnosis, treatment, or advice. You should always consult with a qualified medical professional for any medical concerns related to yourself or your child.

  • Context Limitation: We attempt to make advice as personalized as possible, but this advice should not be taken medically or without consulting a medical professional as they may not apply to all, or may not have the full context of your case.

3.2 AI Assistant Disclaimer

The AI Assistant within the app or web platforms answers parent queries based on our existing database of expert-curated and validated content. Answers from the AI Assistant should be treated as educational and informational only and are not professional counsel or a medical opinion.

3.3 Third-Party Content and Collaborations

Sitaara may collaborate with influencers, guest experts, or other brands. Sitaara is not responsible for the views, opinions, advice, or statements made by any third-party collaborator on non-Sitaara owned platforms or in communications outside of the official, verified Sitaara content channels.

3.4 Limitation of Liability

We are not liable for any direct, indirect, or consequential damages resulting from the use of our platform. Notwithstanding anything contained herein, our monetary liability to you shall not exceed the subscription fees paid by you during a period of 1 year.

4. Intellectual Property (IP)

All content on Sitaara, including text, images, videos, audio, infographics, and logos, is our intellectual property and may not be copied or reproduced without permission.

5. Payments, Cancellations, and Returns

All terms related to subscription cancellation, refunds, product returns, shipping, and delivery are governed by our separate policies: Sitaara's Cancellation & Refund Policy and Sitaara's Shipping & Delivery Policy. By making a purchase or subscription, you agree to be bound by those policies as well.

6. Governing Law

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
